TERMS & CONDITIONS

1.0       Overview

1.1       The festival is organised by Symmetry Events & Festivals (PTY) Ltd.

1.2       All references to “our” or “we” refers to “Symmetry Events & Festivals” / “Symmetry”.

1.3       By purchasing a ticket you agree to be bound by these Terms and all applicable laws and regulations.

2.0       About

The Symmetry Music Festival was born out of a love for music and a desire to bring people together. We wanted to create events that celebrated various genres of music and provide a platform for both established and up-and-coming artists to showcase their talent.

3.0       Mission, Vision, Values

Our mission is to create an environment where music lovers can come together to enjoy great music, make new friends, and create lasting memories, support communities, and create employment. We believe that music has the power to bring people together and inspire positive change.

4.0       Location

4.1       The event will take place at Nekkies Holiday Resort, 6850, Worcester, Western Cape, South Africa.

5.0       Event Dates and Times

5.1       The festival takes place from Friday, 5 December until Sunday, 7 December 2025.

5.2       Music starts at 16:00 on Friday until 02:00, Saturday 12:00 to 02:00, and Sunday 11:00 to 15:00.

6.0       Age Restriction

6.1       The festival is for attendees ages 18+.

6.2       Only original South African ID books/cards, driver’s license cards or state-issued passports will be accepted as valid forms of identification. No certified copies will be accepted.

6.3       Your ID must be kept on your person at all times, ID’s will be verified at the entrance, and you will be asked to present it at certain access points.

6.4       Strictly no student cards, birth certificates, or other forms of identification will be accepted.

6.5       The venue and the event organiser holds the right to revoke your access, without a refund.

6.6       Having a ticket does not guarantee you entrance into the venue, valid identification will be requested at entry points.

6.7       Failure to provide proof of identification will result in you being denied access to the venue, and we will not be liable in any manner whatsoever for refunding you your ticket.

7.0       Your Ticket

7.1       Only weekend tickets can be purchased, there are no tickets for individual days.

7.2       Ticketholders ID/passport numbers are required to purchase a ticket.

7.3       No tickets can be purchased at the event, only through Howler.

7.4       Howler will email your ticket confirmation.

7.5       Once the ticket has been purchased; you will no longer be able to change your ID, address or name on your ticket, unless you transfer your ticket to someone else via your Howler profile.

7.6       Your ticket price includes a camping space of 3m x 3m – when purchasing tickets indicate how many spaces you require, and how many people will be sharing with you (up to 4 people per camp space).

7.7       All tickets purchased must be validated/registered at the festival entrance when collecting your wristband. Bring your ID and ticket confirmation with you (on your phone or printed) and we will issue your wristband before entry to the festival area.

7.8       If tickets are purchased under false identification, you will be denied access. If the name and ID number does not match you will be denied access, with no refund.

7.9     If you present a ticket obtained through any other means, you will be denied access, with no refund.

7.10     You are solely responsible for the safekeeping of your wristband during the event.

7.11     You agree to immediately inform us if your wristband is lost, stolen, damaged or is likely to be used by an unauthorised person.

7.12     Failure to provide your wristband will result in you being escorted out of the venue, and we will not be liable for refunding you.

7.13     Your wristband must be presented when entering/re-entering the festival area, and ID for verification.

8.0       Refunds and Selling a Ticket

8.1       We do not provide any refunds.

8.2       We do not permit reselling or scalping tickets. This immediately invalidates your ticket.

8.3       Tickets may only be transferred to another person through your Howler profile, contact support@howler.co.za for more information. You will be denied admission to the venue if your ticket was resold though any other channels and not verified.

8.4       We reserve the right to cancel tickets if they were purchased illegally or fraudulently via third parties and to institute legal action for any damages we may incur and recover any cancellation costs from you.

8.5       We reserve the right to cancel your order in the event that repeat orders are placed or that may be fraudulent. We will refund the purchase price after deducting a 10% administration fee per ticket.

9.0       Cancellation Policy

9.1       We reserve the right to cancel or reschedule the event at any time, or alter the weekend programme should unforeseen events arise. We endeavour to immediately notify you either via email, SMS, our social media channels, and on our website.

9.2       Your ticket will remain valid, however we are not obliged to refund you full or partial price of your ticket or exchange your ticket, should events arise that are out of our control, these may include but not limited to:

9.2.1     Adverse weather: Extreme weather conditions that make it unsafe to hold the event.

9.2.2     Natural disasters: Earthquakes, floods, hurricanes, and other natural events.

9.2.3     Terrorism or civil unrest: Acts of terrorism or civil disturbances that pose a threat to public safety.

9.2.4     Non-appearance of key individuals: Situations where critical participants (speakers, performers etc) are unable to attend due to illness, injury, or other covered reasons.

9.2.5     Venue unavailability: Unforeseen issues with the event venue, such as structural damage or double-booking.

9.2.6     Global health emergencies: Pandemics and epidemics that force the cancellation or postponement of events to prevent the spread of disease.

9.2.7     Cancellation fees apply, these do not include booking and admin fees:

9.2.7.1  Up to 3 months before the event         

            50% cancellation fee applies

9.2.7.2  30-90 days before the event 

            60% cancellation fee

9.2.7.3  14-30 days before the event

            80% cancellation fee

9.2.7.4  Less than 14 days before, during or after the event                                      

            100% cancellation fee

9.3       Refunds will reflect in the bank account after 21 working days.

10.0     Access to Location

10.1     Inspection at the venue entrance will be in accordance with the applicable laws as prescribed by the Safety at Sports and Recreational Events Act No. 2 of 2010.

10.2     On Friday the gates open at 12:00 and close at 00:00, gates reopen Saturday at 08:00 and close at 00:00, Sunday gates open at 08:00 and close at 18:00.

10.3     Those in Vehicle Camping will be permitted to exit and re-enter after 00:00 but upon re-entering will be directed to a designated parking area, until 08:00 when they can move to the vehicle camping area,

10.4     Upon exiting, you will be checked out, and we reserve the right to request to hand in your wristband.

10.5     Before re-entry into the venue, ticket holders will need to go through strict check-in and security checks again.

10.6     The car park is within walking distance to the entry of the festival grounds.

10.7     Attendees are to stay within the festival area and not venture onto neighbouring properties.

10.8     Attendees can walk down to Brandvlei Dam, but no swimming is allowed there as instructed by the venue.

11.0     Disability Access

11.1     The venue is accessible for people with disabilities.  

11.2     The environment is unfortunately not suitable for a service or guide dog, no animals are allowed in the venue. 

11.3     The disabled car parking is clearly marked and nearest to the festival entrance . Vehicles must display a disability driver tag.

11.4     Accessible disabled toilets are available.

11.5     Please liaise in advance with the event organiser for any requirements.

12.0     Wifi Access

12.1     Wifi access is available in the festival area and camping areas.

12.2     There may be dead spots in certain areas.

12.3     Wifi may go down at times, the venue and the organisers are not liable for any inconveniences or disruption to your experience.

13.0     Transport

13.1     There are dedicated areas outside the festival entrance for taxi and bus drop-offs and collections.

13.2     For your own safety, ticket holders are advised not to vacate vehicles before the drop-off/collection areas.

14.0     Parking

14.1     We charge a R150 once-off weekend parking fee per vehicle, payable at the parking entrance.

14.2     Vehicles that are damaged or stuck etc. may be towed at the owner’s expense.

14.3     Strictly no drinking, gatherings and playing music in the car park, as it is next to camping areas.

14.4     Security is provided to monitor the car park.

14.5     The venue and organiser and their staff, are not responsible for any theft, or damage to your vehicle.

15.0     Accommodation – Camping Ground Rules

15.1     Each ticket includes a 3m x 3m camping spot, each camping spot accommodates up to 4 people.

15.2     Vehicles are not allowed in the camping areas, no drop-offs are allowed.

15.3     Limited vehicle/caravan camping is available at an additional R500 for a 5m x 6m space, available to purchase through Howler.

15.4     A vehicle camping sticker will be handed to you when registering at the entrance. Vehicles who do not have a vehicle camping sticker, may not enter the vehicle camping area.

15.5     All camping spaces are first-come first-served, please follow the direction of staff to the next available space, we have allocated areas for walkways, toilets and shower facilities.

15.6     Staff will be on hand to assist in setting up tents if required. The venue and event organiser do not provide tents or glamping.

15.7    Security is provided in the camping areas, but we take no responsibility for items being stolen out of tents. We advise to bring a tent lock.

16.0     Smoking Policy

16.1     No smoking is allowed under canopies and in any tents.

16.2     No smoking areas are clearly marked.

16.3     We urge you to not flick cigarettes into bushes, please ensure your cigarette is dead before disposing of.

17.0     Drinking

17.1     Alcohol is not for sale to persons under the age of 18.

17.2     The venue and event organisers are not responsible for any harm to ticket holders due to actions from alcohol consumption.

17.3     We urge ticket holders to drink responsibly, passing out from alcohol intoxication, will result in medics transporting you to the nearest hospital at the ticket holders’ expense.  

17.4     Strictly no intoxication and aggressive behaviour will be accepted, ticket holders will be escorted out of the event, and no refunds will apply. 

17.5     If anyone sees something that isn’t right, they are to notify security or festival staff immediately.

17.6     Any person found supplying alcohol to anyone under 18 will be escorted out of the venue.

18.0     Drugs

18.1     Drugs or substances that has a narcotic effect, are strictly prohibited; ticket holders agree to allow festival security to do checks.

18.2     It is strictly forbidden to use, carry or deal drugs at the venue.

18.3     If you are caught violating/breaching our drugs policy, you will immediately be detained and handed over to the South African Police Service for prosecution.

19.0     Denied Access

19.1     These scenarios may include:

19.1.1        Refusal to be searched by the event security;

19.1.2        Behaviour that may put the lives or well-being of other ticket holders at risk;

19.1.3        Behaviour that solicits discrimination, hate, incites violence, intimidating, or religiously offensive;                

19.1.4        In possession of illegal or banned objects;

19.1.5        Disregards and non-compliance to the event terms and conditions.

19.2     If you have previously been denied access and you are found in the festival ground, we reserve the right to immediately detain you and hand you over to the South African Police Service for prosecution, without a refund and re-entry into the event.

20.0     Dress Code

20.1     Attendees are encouraged to dress up.

20.2 Strictly no nudity, no apparel allowed that would be offensive, costumes that disrupt the event and put others at risk, apparel that incites discrimination, hate speech, racism, including symbols or text, representing a group, social movement or political parties.

20.3     Please come prepared for all weather conditions.

20.4     Theme keywords: neon, shimmer, glow, year of the snake.

21.0     Media Consent

21.1     When you purchase your ticket, you automatically give your consent to be filmed and photographed at the event.

21.2     You consent that images and videos taken at the event may be used for our external marketing and promotional purposes indefinitely without compensation to you. We will ensure that all images and videos will not be sold and distributed to third parties.

21.3     You may not use or copy photos and videos from any of our platforms for your own marketing purposes without our consent. We do encourage you to share content from our social media platforms to yours.

21.4     You agree and consent that the venue has the right to record and monitor activity on their surveillance system.

22.0     Attendee Promise

22.1     Ticket holders agree to follow festival policies and posted instructions at the festival.

22.2     All attendees should evaluate their risk in determining whether to attend the festival.

22.3     By entering the festival, attendees voluntarily assume all risks related to the venue, and activities.

22.4     We request and trust that festivalgoers will act responsibly, be respectful, and make good life choices.  

22.5     Actions not permitted, not limited to:

22.5.1        Obstruct entrances, exits, and emergency exits;

22.5.2        Climb on structures, fences, or any other erections;

22.5.3        Damage decorations;

22.5.4        Sell food, drinks, products, or services of any kind;

22.5.5        Damage or destroy property of other attendees;

22.5.6        Stealing or pick-pocketing;

22.5.7        Throw objects in solid, liquid or gas form;

22.5.8        Throw any item into the crowd, or onto the stage;

22.5.9        Smoke in non-smoking areas;

22.5.10      Flick cigarettes into bushes;

22.5.11      Urinate and/or defecate in public;

22.5.12      Make fires;

22.5.13      Begging;

22.5.14      Bad attitudes;

22.5.15      Racial, negative, religious, rivalry songs or chanting.

This list is not exhaustive, if we witness attendees behaving in a manner not permitted by staff, security, the venue or the event organiser, we reserve the right to escort attendees out of the venue, and/or hand attendees over to the police.

23.0     Permitted Objects

23.1     The following objects are permitted in the venue:-

23.1.1        Camera phone, disposable/compact photo cameras, GoPro;

23.1.2        Power banks; portable cell charger;

23.1.3        Sunglasses, hats, caps;

23.1.4        Hand umbrellas, beach umbrellas and large parasols only allowed in camping areas;

23.1.5        Hand fan (paper and electronic);

23.1.6        Deodorant, sunscreen, spritzers/misting spray, cosmetics, hand-sanitizing wipes;

23.1.7        Moon bags, sling bags, backpacks and handbags;

23.1.8        Illuminated or glowing jewellery or costumes;

23.1.9        ‘Selfie-sticks’ (max 1m in length);

23.1.10      Tents, 3m x 3m gazebos, camp chairs, inflatable chairs, blankets, sleeping bags;

23.1.11      Torch, headlamp;

23.1.12      Swimming attire, towels, inflatables;

23.1.13      Warm clothes, rain jacket/poncho, comfortable shoes;

23.1.14      Earplugs;

23.1.15      Cooler box – only allowed in camping areas;

23.1.16 Decanter alcohol into plastic containers, plastic bottled water and soft drinks allowed;

23.1.17 Flags and banners (as long as they are not offensive, disrupt the event, put others at risk, incites discrimination, hate speech, racism, including symbols or text, representing a group, social movement or political parties).

24.0     Banned Objects

24.1     The following objects are not permitted to enter the venue and festival space:-

24.1.1        Sharp or pointed metal objects that can reasonably be considered to be a dangerous weapon; Any dangerous weapon as contemplated in section 1 of the Dangerous Weapons Act No. 63 of 1968; You are prohibited by law from carrying firearms and ammunition, weapons are not limited to, guns, pocket-knives, air-guns, cross-bows, pepper spray, tear gas, mace, or airborne chemical agent as per Section 1 of the Tear-Gas Act No. 16 of 1964.

24.1.2        No Illegal/illicit substances, drugs, drug paraphernalia, or other mind-altering substances;

24.1.3        No hookah/Shisha;

24.1.4        No animals allowed, including service/guide dogs;

24.1.5        No gas cookers, no fires or braais allowed (these include wood, coal, combustible liquid cooking appliance or items); No cooking in any areas of the venue;

24.1.6        No harmful chemicals, explosives or toxic substances onto the premises;

24.1.7        No flammable items or liquids, aerosols, fireworks or sparklers, and Chinese lanterns;

24.1.8        No outside food and condiments;

24.1.9      Strictly no glass allowed. No beers and ciders allowed. Decanter alcohol into plastic containers, plastic bottled water and soft drinks allowed;

24.1.10      No balloons, streamers and confetti;

24.1.11      No motorized vehicles, skates, rollerblades, bicycles, skateboards, scooters, etc.;

24.1.12      No professional cameras, video and audio recording equipment, tripods, totems, camera poles;

24.1.13      No drones;

24.1.14      No lighting devices and lazers;

24.1.15      No independent sounds systems.

25.0     Environment

25.1     When booking a ticket, you pledge to participate in our festival leaving a positive impact on our home and join us on our journey towards a green sustainable event.

25.2     You agree to abide by our Festival Guide, highlighting our strong commitment to an environmentally friendly festival.

25.3     Attendees need to look out for snakes and spiders, contact security to arrange the removal.

25.4     Attendees can drop off their respective rubbish at the waste station, located behind the market; refuse bags are supplied at the waste station if required.

26.0     Entertainment and Facilities

26.1     The following entertainment will be arranged for ticket holders pleasure. We take no responsibility for any harm that comes to a ticket holder through their own use and negligence when taking part in these activities.

26.1.1       Main stage (blankets and camp chairs are allowed on the outskirts of the area (no cooler boxes, large umbrellas and parasols allowed);

26.1.2       River stage and dancefloor (blankets and camp chairs are allowed outside the tent);

26.1.3       Games and amusement area;

26.1.4       The river, the pool, giant inflatables, and water slides;

26.1.5       Beer tent and big screen;

26.1.6       Bubbles bar, tiki bar, wine bar, craft beer, pool bar;

26.1.7       Food trucks and tuck shop;

26.1.8       Market and merchandise;

26.1.9       Chill areas;

26.1.10      Neon body painters (at own expense);

26.1.11     Light shows;

26.1.12      Professional dancers/acts/DJs;

26.1.13      Competitions and prizes;

26.1.14      Spa with hairdryers (free to use); hair stylists and nail bar (at own expense);

26.1.15      Toilets and hot showers;

26.1.16      Unfortunately no lockers are available.

27.0     Swimming

27.1     The river and pool is accessible from 08:00 until 18:00;

27.2     Lifeguards will be available for your safety, lifeguards always have the final say, no exceptions;

27.3     No swimming is permitted if the lifeguard accesses that you are under the influence and a danger to yourself, and/or others;

27.4     No diving;

27.5     No nudity and skinny dipping;

27.6     No swimming is allowed between 18:00 and 08:00, monitored by security during this time.

27.7     The venue and the event organiser take no responsibility for your safety if you do not abide by the access rules above.

27.8     No shampoo or soap is allowed in the river or the pool.

28.0     Food and Water

28.1 No food and condiments are allowed into the festival.

28.2     Festivalgoers will have a wide selection of various cuisines to select from, all vendors have provided their certificates to sell food to the municipality for this event. 

28.3     By purchasing a ticket you agree that the venue and event organiser take no responsibility if any harm comes to you from purchasing and consuming from the vendors.

28.4     The venue cannot guarantee that all the vendors will be attending on each day.

28.5     Vendors will only serve food between 06:00 until 23:00 on Friday and Saturday and until 15:00 on Sunday.

28.6     Free drinking water is available at various marked areas at the venue, and in the bathrooms.

29.0     Health and Safety

29.1     You agree to follow all festival policies and posted instructions while at the festival.

29.2     You agree to evaluate your risk in determining whether to attend the festival.

29.3     By entering the festival, you voluntarily assume all risks related to the venue, activities, and exposure to COVID-19.

29.4     You agree to ensure that your actions don’t affect and cause harm to other ticket holders.

30. Safety

30.1     To ensure public order and safety during the event, you are obliged to obey our instructions and directions and/or those of our authorised representatives at the festival venue.

30.2     The Symmetry Music Festival reserves the right to:-

30.2.1        Interrupt or discontinue the festival at any given time;

30.2.2        Prevent you from going into festival venue or from leaving festival venue until further notice;

30.2.3        Ask you to leave festival venue; or

30.2.4        Refuse your admission into festival venue, even if you possess a valid ticket.

30.3     We work closely with law enforcement and public safety agencies to ensure the safety of attendees. These include security personnel, medics and ambulances, police, emergency services, lifeguards, night-time security patrols, and toilet attendants; who are all on site 24/7 and ready to assist at any time.

30.4     By purchasing a ticket you agree to abide by the rules and regulations in place to prevent any dangerous or illegal behaviour.

30.5     Theft is to be reported to security at the VOC office.

30.6     Fire Safety will be situated at various points in each area. If attendees see a fire please put it out or find your nearest fire safety or security officer.

31.0     Security

31.1     Attendee safety is our main priority, we have employed security services that specialise in festival safety and crowd control.

31.2     You are advised to safely store away your valuables and be vigilant at all times.

31.3     Ticket holders agree to abide by all safety measures put in place, not limited to bag checks, metal detectors, this applies to festivalgoers, staff, and performers.

31.4     Security personnel of the same sex as you, may request you to be subjected to a thorough pat-down and/or search of your clothes and personal items, to intercept banned objects. If any prohibited objects are found in your possession, the security personnel is authorized to confiscate the objects/s and may refuse your admission into the venue.

31.5     Security personnel always have the final say, with no exceptions.

32.0     Medics

32.1     Trained EMTs and medical support personnel onsite are provided at all times. 

32.2     Medics will be allocated to medic tents and ambulances at emergency exits.

32.3     Medics are placed strategically in the field during the event with a centralised medical base, situated by the VOC office.

32.4     You agree to abide by all instructions given by medic personnel.

33.0     Lost and Found

33.1 We have a designated Lost & Found located by the VOC Office, where attendees can hand in items found or make enquiries about anything lost. We have sufficient secure storage to safeguard valuable items. We log all items that are handed in by taking a photo of the item, logging full details of the item, the time and place.  

33.2 We advise attendees to lock their phones and ensure passwords aren’t automatically saved.  

33.3 If you have misplaced anything, you can check our Lost & Found Catalogue on our website after the festival. If the item is not on the list, we accept applications for lost property, email info@symmetryeventsandfestivals.com to make an application for lost property, including item brand, codes, passwords, full description, details of where and when the items were last seen.

33.4 Items without an ID will be held for 30 consecutive days after the festival, after that the item will be donated to a charity of our choosing, this includes glasses, bags, jewellery, watches and clothes. For more valuable property like mobile phones, cameras, bank cards, passports, wallets and driving licences they could be held for 60 consecutive days, before being handed to the police or securely destroyed.

33.5 Once the item has been handed over to its owner, the ID of the owner is required to close out the item on our system.

33.6     We encourage ticket holders to adopt our honesty policy when finding items. 

34.0     Sale of Official Merchandise

34.1     Symmetry merchandise is available to pre-order on our website and collect at the festival market, and will be available for sale at the venue market.

34.2     Third party merchant sellers are not permitted to sell Symmetry merchandise at the festival.

34.3     Symmetry and the venue take no responsibility for faulty items purchased at the market and the refund thereof.

35.0     Disclaimer

35.1     By attending a Symmetry event, you explicitly agree that your attendance is at your own risk. We endeavour to provide a service of the highest quality but cannot guarantee the quality of any services provided by independent contractors. There may be occasions when services may be interrupted due to strikes, riots, emergency repairs, technical failures or other reasons beyond our control, including force majeure.

35.2     We make no representations or warranties of any kind, express or implied, with respect to the festival of its operation, or any services offered at the festival.

35.3     We accept no liability or responsibility whatsoever for any loss of damage you may suffer by any person at the festival.

35.4     By attending the festival, you are deemed to accept these terms. 

36.0     Limitation of Liability

36.1     To the fullest extent permitted by the laws of the Republic of South Africa, Symmetry Events and Festivals (PTY) Ltd, and its affiliates, officers, directors, employees, agents, and contractors (collectively, “Festival Parties”) shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or in connection with your participation in or attendance at the Symmetry Music Festival (the “Event”), even if Festival Parties have been advised of the possibility of such damages. This includes, but is not limited to, any damages arising from:

36.1.1        Injuries or Illnesses:

Any injuries, illnesses, or death suffered by you or your dependents during or as a result of your attendance at the Event, unless caused by the gross negligence or wilful misconduct of Festival Parties.

36.1.2        Lost or Damaged Property:

Any loss, theft, damage, or destruction of your personal property, including but not limited to, clothing, electronics, or other items, unless caused by the gross negligence or wilful misconduct of Festival Parties.

36.1.3        Weather Conditions:

Any damages or inconveniences caused by inclement weather or other natural disasters.

36.1.4        Acts of Others:

Any actions or omissions of other attendees, performers, or third parties.

36.1.5        Force Majeure:

Any events beyond the reasonable control of Festival Parties, including but not limited to, acts of God, war, terrorism, civil unrest, or government regulations.

36.1.6        Specific Exclusions:

Any damages related to, but not limited to, noise levels, crowd control, or any other aspects of the Event that are inherent to the nature of a music festival.

36.1.7        Entry is completely at your own risk.

36.1.8        Right of admission is reserved.

36.1.9        Exceptions:

This limitation of liability does not apply to claims for damages caused by the gross negligence or wilful misconduct of Festival Parties.

This limitation of liability does not affect any statutory rights you may have under consumer protection laws.

By attending the Event, you acknowledge that you have read, understand, and agree to be bound by this limitation of liability.

37.0     Indemnification

You hereby agree to indemnify Symmetry and its owners, directors, officers, employees and agents against any costs, claims, suits, proceedings, disputes, losses and damages (including legal fees) incurred by or awarded against Symmetry as a result of your acts and/or omissions at the event, violation of any third party right, violation of any laws and regulations, any misrepresentation made by you or any other person or persons or your breach or alleged breach of these Terms.

38.0     Breach of Terms

38.1     If you breach any of these Terms, Symmetry reserves the right to restrict or deny you access to all or any part of the festival.

39.0     Amendment to Terms

39.1     Symmetry reserves the right to amend or modify these Terms at any time and at its sole and absolute discretion without prior notice.

39.2     Please ensure you review our Terms on a regular basis to ensure you have read the latest version. Your continued attendance at Symmetry following changes to these Terms implies that you have consented to those changes.

40.0     Termination of the Symmetry Terms

40.1     Symmetry shall be entitled without notice to terminate these Terms at its sole and absolute discretion and reserves the right to modify or discontinue all or any part of the Symmetry Festival and to restrict or prohibit your access to it at any time, without liability to you or any other person.

40.2     Upon termination, all rights granted to you in respect of these Terms will immediately cease.

41.0     Choice of Law

41.1     The Laws of the Republic of South Africa shall govern these Terms.

41.2     In the event of a dispute of these Terms, any competent division of the High Court of the Republic of South Africa will have jurisdiction.

41.3     In the event that any provisions of these Terms are found to be invalid, unlawful or unenforceable by any competent authority, such provision shall be severed, and the remaining provisions will continue in full force and effect.

42.0     Complaints and Disputes

42.1     All complaints and disputes regarding Symmetry and the festival may be addressed to info@symmetryeventsandfestivals.com

42.2     Your complaint will be dealt with in a reasonable period of time after receipt thereof, and where necessary, you may be called upon to provide satisfactory evidence.

43.0     Privacy

43.1     Symmetry respects your privacy and will not disclose your personal information to third parties for marketing purposes if you request us not to do so. By purchasing a ticket to the festival, you consent to the processing of your personal information for promotional and commercial purposes and warrant that all data provided by you is accurate and up to date. You are responsible for maintaining and promptly updating account information for accuracy and completeness.

43.2     If you object to your personal information being used for promotional and commercial purposes, you may submit, at no cost, a written request to us to stop this use.

43.3     Please refer to our Privacy Policy on our website.

44.0     General

44.1     You may not cede, assign or otherwise transfer your rights and obligations in terms of these Terms to any third party.

44.2     No variation, addition, deletion, or agreed cancellation of these Terms will be of any force or effect unless in writing and accepted by or on behalf of the parties hereto.

44.3     These Terms contain the whole agreement between you and Symmetry, and no other warranty, representation or undertaking is valid unless contained in this document.

44.4     Any failure on you or Symmetry to enforce any right in terms hereof shall not constitute a waiver of that right.

44.5     The headings used in these Terms are included for convenience only and will not limit or otherwise affect these Terms.
